Welcome to TagMyBeat ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the TagMyBeat website, API, and AI producer tag generation services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Tag_My_Beat provides an AI-powered audio synthesis platform that allows music producers, DJs, and creators to generate custom vocal tags, drops, and audio signatures (collectively, "Generated Audio" or "Tags"). The Service may include features such as text-to-speech generation, voice cloning, and audio effect processing (e.g., reverb, delay, distortion).

2. User Accounts and Credits

  • Registration: You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials.
  • Credits/Subscriptions: Our Service operates on a credit-based or subscription model. You agree to pay all fees associated with the plan you select. Credits purchased are non-refundable unless otherwise required by law or explicitly stated on our pricing page.
  • Account Termination: We reserve the right to suspend or terminate your account at any time, without notice, if we determine you have violated these Terms.

3. Intellectual Property and Commercial Rights (Your Content)

We believe in empowering creators. Our stance on ownership is simple:

  • Platform Ownership: TagMyBeat retains all rights, title, and interest in and to the Service, including the website, underlying AI models, software, design, and logos.
  • Your Inputs: You retain all rights to the text prompts, original scripts, and original audio samples you upload to the Service.
  • Absolute Ownership of Generated Audio: You own the Generated Audio. Upon successful generation (and deduction of associated credits/fees), TagMyBeat assigns to you full, exclusive, and royalty-free rights to the final producer tags you create using your account.
  • Commercial Usage: You have the unrestricted right to use, monetize, distribute, broadcast, and incorporate the Generated Audio into any commercial or non-commercial projects (including beats, songs, DJ mixes, podcasts, and videos) without requiring attribution to TagMyBeat.

4. Voice Cloning and Acceptable Use Policy

If you use our [ Clone_Voice ] feature or any other text-to-speech feature, you must strictly adhere to the following rules. TagMyBeat is a tool for personal branding, not impersonation.

You agree NOT to use the Service to:

  1. Impersonate: Clone the voice of any real person, celebrity, artist, or public figure without their explicit, documented legal consent.
  2. Infringe: Upload audio samples that you do not own or have the right to use.
  3. Generate Illegal Content: Create tags that contain hate speech, harassment, defamatory statements, threats, or content that incites violence.
  4. Deceive: Use the Generated Audio to commit fraud, deepfake scams, or mislead the public.

Liability for Cloned Voices: You are solely responsible for ensuring you have the legal right to use any voice sample you upload. TagMyBeat actively disclaims any liability for copyright infringement, right of publicity violations, or defamation resulting from your use of the voice cloning feature. We reserve the right to delete violating audio and ban accounts that abuse this feature.

5. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code or AI models underlying the Service.
  • Use automated scripts, bots, or scrapers to access the Service or generate audio in bulk outside of our official API (if provided).
  • Interfere with or disrupt the integrity or performance of the Service.

6. Disclaimer of Warranties

The Service and Generated Audio are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide "studio quality" synthesis, TagMyBeat makes no warranties, express or implied, regarding the specific audio quality, fitness for a particular purpose, or uninterrupted availability of the Service. AI generation can sometimes produce unpredictable artifacts; we do not guarantee that every generation will be flawless.

7. Limitation of Liability

To the maximum extent permitted by law, TagMyBeat and its founders, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (including lost beat sales or copyright strikes), whether incurred directly or indirectly, resulting from:

  • Your access to or use of, or inability to access or use, the Service.
  • Any conduct or content of any third party on the Service.
  • Any copyright claims arising from your use of generated audio or cloned voices.

In no event shall our aggregate liability exceed the total amount you paid to us in the past twelve (12) months for the Service.

8. Indemnification

You agree to indemnify, defend, and hold harmless TagMyBeat from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights (especially regarding the Voice Cloning feature).

9. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) with or without notice. We may also revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.
